A teenager has been cleared to sell or supply drugs after he was found with six offers of cannabis in a box of cigarettes.
osh Tierney (18), Westbrook Avenue, Balbriggan admitted to possessing the drugs at Westbrook Rise on September 11, 2021, but denied it was for sale or supply.
Garda Keith Coleman told the court he attended the scene following reports of youths acting suspiciously in a vehicle.
The car was searched and six separate bags containing suspected cannabis resin were found concealed in a cigarette box.
The accused admitted it was his property, the garda said.
The drugs had a combined weight of 22.3g with an estimated market value of €446, Garda Coleman told the court.
Defense lawyer Fiona D’Arcy said Tierney admitted to owning the drugs and told Gardaí it was for his personal use.
She said there was no evidence of sale or supply with no money, scale, checklist or anything else to suggest he intended to sell or supply the cannabis to anyone. ‘others.
Ms D’Arcy said she did not believe the state had gone far enough to prove her case.
In district court, Judge Dermot Dempsey said he would give the defendant “the benefit of the doubt” and cleared Tierney of possession of drugs for sale or supply.
He convicted the defendant of drug possession and imposed a fine of €250 on him with an order to destroy the seized cannabis.
